§ 1 Scope

FATMOOSE is a brand of Wickey GmbH & Co. KG. The competition is organized by Wickey GmbH & Co. KG.

§ 1 Scope

These terms and conditions apply to participation in the fatmoose Easter Egg Hunt campaign. Participation in the fatmoose Easter Egg Hunt campaign is subject exclusively to the following terms and conditions.

§ 2 Competition

(1) The competition is organized by WICKEY GmbH & Co. KG, Franz-Savels-Straße 69, 52538 Gangelt, Germany.

(2) This competition is in no way connected with [Instagram] and is neither sponsored, supported nor organized by [Instagram].

(3) The competition is limited in time. The competition starts on 13.03.2026. The competition ends on 29.03.2026 at 24:00.

(4) Our prizes for the winners are:
1st place: a play tower of your choice or a refund if a play tower has already been purchased
2nd place: 2 winners will receive a €200 voucher for the fatmoose shop
3rd place: 3 winners will receive an accessory of their choice

(5) This competition cannot be combined with other competitions.

§ 3 Participation

(1) Eligible participants are natural persons with legal capacity who are at least 18 years old. Employees of Wickey GmbH & Co. KG and their family members are excluded from participation.

(2) A prerequisite for participation is that the participating user follows the [Instagram account] of fatmoose GmbH & Co. KG and solves the riddle described in the competition post. The participating user must also post their solution as a comment under the corresponding competition post on the [Instagram account]. Registration for the competition takes place once the participating user has successfully posted their comment and follows [fatmoose].

(3) Wickey GmbH & Co. KG may exclude participants from the competition without stating reasons. In particular, this applies if the participant has provided inaccurate or incomplete registration data. In the event of a violation of the participation conditions or a justified suspicion of such a violation by the participant, Wickey GmbH & Co. KG is entitled to exclude the respective participant with immediate effect. In such a case, Wickey GmbH & Co. KG is entitled to revoke prizes and/or demand their return if necessary.

(4) Only one entry per participant is permitted.

§ 4 Implementation and Processing

(1) The winner will be determined by random draw from all correct comments. The draw will take place within 7 days.

(2) The prize is non-transferable.

(3) The winners must contact Wickey GmbH & Co. KG via direct message within 7 days after the notification of the prize has been sent. If the winners do not contact Wickey GmbH & Co. KG within 7 days after the notification has been sent, the prize will expire without replacement.

(4) The winners must provide Wickey GmbH & Co. KG with all necessary information required to process the prize.

§ 5 Participation Data

(1) The participant agrees that their name may be used and published by Wickey GmbH & Co. KG for marketing purposes in the event of winning.

(2) The participant expressly agrees that photographs may be taken of them on behalf of Wickey GmbH & Co. KG and published online to promote the competition. The participant agrees that these photographs, together with the participant’s name, may be made publicly accessible for the self-promotion of Wickey GmbH & Co. KG and may be forwarded by Wickey GmbH & Co. KG to the press as part of press work and reporting on the specific competition and/or competitions of Wickey GmbH & Co. KG in general. The participant’s consent also applies to the publication of the images and their name in print media and other media. The participant has no claim to the publication of their name or the photographs taken. They have no entitlement to any remuneration arising from the publication of the data and images in accordance with this provision.

(3) The participant expressly agrees that Wickey GmbH & Co. KG may store their registration data for the duration of the competition and, in the event of winning, for the purpose of sending the prize and for publication in accordance with paragraph 1.

§ 6 Rights and Obligations of Wickey GmbH & Co. KG

(1) Wickey GmbH & Co. KG does not verify the registration data.

(2) Wickey GmbH & Co. KG is entitled to cancel the competition at any time. In the event of cancellation, participants do not need to be informed of the reasons. Cancellation may occur if, for technical or legal reasons, the proper implementation of the competition can no longer be guaranteed. If the cancellation is caused by the behavior of a participant, Wickey GmbH & Co. KG may claim damages.

(3) In the event of a violation of these participation conditions or a justified suspicion of such a violation by a participant, Wickey GmbH & Co. KG is entitled to exclude the respective participant.

§ 7 Liability

(1) Wickey GmbH & Co. KG shall be liable without limitation for damages caused intentionally or through gross negligence by Wickey GmbH & Co. KG, its legal representatives, senior employees or simple vicarious agents.

(2) In cases of slightly negligent breaches of only non-essential contractual obligations, Wickey GmbH & Co. KG shall not be liable. Otherwise, liability for damages caused by slight negligence shall be limited to those damages that typically must be expected within the scope of the contractual relationship. This also applies in the case of slightly negligent breaches of duty by legal representatives, senior employees or simple vicarious agents. The limitation of liability does not apply to claims arising from injury to life, body or health of the participant, insofar as this is attributable to Wickey GmbH & Co. KG.

(3) All information is provided without guarantee. This applies in particular to the publication of the names of the winners.

§ 8 Data Protection

(1) Wickey GmbH & Co. KG treats the registration data of participants confidentially and only makes it available to third parties insofar as this is permitted by data protection law, is necessary for carrying out the competition and awarding the prize, or if the participant has consented.

(2) Wickey GmbH & Co. KG points out that the participant’s personal data will be processed electronically. The data will be used solely for the implementation of the competition and for promotional purposes in accordance with § 5, unless otherwise agreed.

(3) With the information on the processing of personal data, Wickey GmbH & Co. KG informs the participant about the type, scope, duration and purpose of the collection, processing and use of personal data, their right to free information about their personal data stored by Wickey GmbH & Co. KG and their right to correction, deletion and blocking of this data.

§ 9 Legal Recourse

Legal recourse is excluded.

§ 10 Final Provisions

(1) The law of the Federal Republic of Germany shall apply. For consumers who do not conclude the contract for professional or commercial purposes, this choice of law shall only apply insofar as the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has their habitual residence. The provisions of the UN Convention on Contracts for the International Sale of Goods shall not apply.

(2) If the participant has no general place of jurisdiction in Germany or if their residence or habitual abode is unknown at the time the action is filed, the exclusive place of jurisdiction for all disputes arising from this contract shall be the registered office of Wickey GmbH & Co. KG.

(3) Should individual provisions of these participation conditions be or become wholly or partially invalid, this shall not affect the validity of the remaining provisions.
